Authority

The Superintendent is authorized to accept or reject any transfer requests, provided that such action does not discriminate on the basis of race, religion, color, sex, disability, national origin, or ancestral language.

The Board shall approve the list of campuses open for transfers.

Transfer Requests

A student wishing to transfer into the District shall file an application for transfer with the Superintendent or designee.

Child of Nonresident Employee

Children of nonresident employees shall be allowed to transfer to the campus of the employee's choice if room permits. Persons who work in a temporary capacity, such as substitute teachers or temporary personnel, shall not be considered employees for purposes of this policy.

Resident Student Who Becomes a Nonresident

A resident student who becomes a nonresident during the course of a grading period shall be permitted to continue in attendance for the remainder of the grading period tuition-free.

A resident student who becomes a nonresident after the end of the fourth six weeks shall be permitted to continue in attendance for the remainder of the school year tuition-free.

A student who receives a transfer under one of these circumstances shall not be guaranteed a transfer for the following school year and must apply for another transfer in order to continue in attendance.

Factors

In determining whether a nonresident student shall be permitted to enroll in District schools, the Superintendent shall consider the following factors:

The availability of space and instructional staff.

The student's disciplinary and criminal record.

A student shall not be allowed to transfer into the District if he or she has incurred a disciplinary alternative education program (DAEP) placement or has been suspended or expelled for one or more days during the most recent school year.

Recurring or persistent disciplinary problems may be sufficient reasons for rejecting a transfer request.

The student's attendance record. A student shall not be allowed to transfer into the District if his or her attendance records for the most recent school year indicate less than 90 percent attendance.

Whether the student made satisfactory academic progress during the previous school year. A student shall not be allowed to transfer into the District if he or she has not performed at or above grade level on the most recent state-mandated assessments and satisfied requirements for all academic courses from the previous school year.

Any additional factors not prohibited by law as deemed relevant by the Superintendent.

The Superintendent may consider special or extenuating circumstances.

Transfer Agreement

Before a transfer student is admitted to District schools, the student's parent must complete the transfer request form and provide complete documentation for the selection criteria. A transfer shall be in effect for one school year only.

A transfer student shall be notified in the written transfer agreement that he or she must follow all rules and regulations of the District. Violation of the terms of the agreement may result in a transfer request not being approved the following year.

Acceptance of a transfer student in one school year, either during the school year or from the prior year, creates no right or expectation that a student will be admitted as a transfer student in subsequent years. Admission of one student in a family as a transfer student creates no right or expectation that another student from the same family will be admitted as a transfer student.

Tuition

The District shall charge tuition, and the amount shall be annually set by the Board, within statutory limits.

Waivers

The Board may waive tuition for a student based on financial hardship upon written application by the student, parent, or guardian. [See FP]

Nonpayment

The District may initiate withdrawal of students whose tuition payments are delinquent.

Transportation

Transportation of a nonresident transfer student shall be the responsibility of the student's parent or guardian.

Appeals

Any appeals shall be made in accordance with FNG(LOCAL) and GF(LOCAL), as appropriate.
